TERMS OF SALE TERMS OF PAYMENT
Standard terms of payment are Net 30 Days from the date of invoice subject to prior credit approval by Kalco Lighting Limited. Special terms must have prior credit approval. All returned checks are subject to a $50 service charge. Accounts not paid according to terms become delinquent and are subject to a 2% service charge per
month for the unpaid balance.
Credit availability is granted at the discretion of the creditor. A creditor may terminate credit within its sole discretion. All purchases are to be paid for according to the terms of the creditor. The buyer will be responsible for any costs and fees resulting from the collection of past-due balances. All disputes arising between the creditor and the buyer shall be governed by the laws of the State of Nevada and Clark County. In the event of litigation, the venue will be Las Vegas, Nevada. Kalco Lighting Limited retains the right to all property until paid in full.
Prices are subject to change without notice and supersede all previous prices shown.
The usual delivery time for all catalog products (excluding custom manufactured products) is 3-12 days, based on inventory availability. Please call Kalco Customer Service for current delivery times and inventory availability. Delivery time may occasionally be affected by circumstances outside Kalco’s control.
LARGE QUANTITY ORDERS
Large quantity or project orders require a 50% deposit and may not be canceled.
All of our products are regularly inspected by the transportation carriers who assume responsibility for both apparent and concealed damage by improper handling. It is the responsibility of the ordering party to unpack merchandise upon receipt and to carefully inspect the products for concealed damage. Any damage must be recorded on the bill of lading and reported immediately. Title passes to the purchaser upon delivery by the carrier* and all claims for damage
and shortages in transit shall be made by the purchaser with delivering carrier within 7 days of delivery.
*Title passes to the purchaser at the time of pick-up when shipped by using the purchaser’s carrier.
All orders are shipped F.O.B. factory (Nevada), free freight allowed (FFA) on orders of $1750. These freight allowances are applicable to all Kalco catalog products. Freight allowance is calculated on the NET order (after all discounts). Orders that do not reach the freight allowance threshold will be subject to a 15% freight charge when shipping west of the Mississippi River or 18% if shipping east of the Mississippi (please reference map below).
Orders are shipped via Kalco’s preferred carriers. Freight-allowed orders will be shipped within the contiguous 48 states of the U.S. to the port of departure. The customer is responsible for all charges from the port of departure to the ultimate destination. Kalco will ship in the manner selected by the customer if the customer assumes responsibility for any additional transportation charges. All non-catalog items including made-to-order and customized products are shipped at the buyer’s expense only. FFA policy does NOT apply to custom-quoted jobs or projects.
RESIDENTIAL DELIVERY CHARGE AND DROP SHIP CHARGES
Any and all Carrier Assessed Fees are the responsibility of the purchasing party. Please contact customer service for current rates.
Please note that any additional fees assessed by the carrier, such as requests at point of delivery for special service such as “inside delivery” are not authorized by Kalco Lighting Limited, and if such charges are incurred, purchaser will be billed and held responsible for those additional carrier assessed fees.
Additional charges will be assessed to any order that specifies a ship-to address that is not a commercial address or a distributor’s normal ship-to address. These charges are based on carriers’ fees only.
Kalco Lighting reserves the right to make engineering changes to our products without prior notice. This may result in minor design changes.
ORDER CANCELLATIONS—MUST BE SUBMITTED AND CONFIRMED IN WRITING
Stock orders cancelled prior to production or shipment will not result in additional charges.
Orders cancelled within 30 days of shipment will be assessed a 25% restocking fee, and customer will be responsible for return freight.
Products must be returned unopened and in original packaging. Customized (e.g. product for which a customer has selected a specific finish, etc.) and discontinued product orders may not be returned after shipment.
It is recommended that a licensed electrician, in accordance with electrical and building codes, install Kalco Lighting products. All Kalco Lighting products are UL or ETL listed. Consequently, as UL or ETL guidelines are altered, the wattage rating in Kalco Lighting catalogs may be subject to change. Heavy fixtures require the weight to be supported independently from the outlet box, and are provided with a safety cable.
All returns must have prior written authorization from Kalco Lighting Limited. We will issue a Return Materials Authorization (RMA) for all approved returns. All products returned on an RMA MUST be returned via Kalco’s preferred carrier; otherwise, shipment to Kalco must be prepaid. Items should be returned in the original packaging.

• No parts return – chain, glass, spare parts. Non-returnable.
• Custom and discontinued items are considered final sale and non-returnable.
Kalco quality control personnel will review all returned products. Any products with defects which Kalco personnel determine are not Kalco’s responsibility will be returned to the sender at sender’s expense. Return authorization will be voided and credit will not be issued if merchandise is not received at the Kalco factory within 30 days of authorization. The consumer/purchaser is responsible for any costs incurred for the transportation of the product to and from Kalco.
CUSTOM MANUFACTURED PRODUCTS TERMS OF SALE:
1. All prices are quoted in U.S. Dollars and are F.O.B. factory Nevada.
2. Customer is responsible for all freight costs from factory to job site and for all applicable taxes.
3. Prices are quoted for the quantities and products specified in the quotation. Changes in quantities and/or specifications may affect price.
4. A 50% deposit and non-cancellable P.O. are required to begin production of shop drawings and/or fixture fabrication. To expedite processing of your custom order, Kalco recommends that any deposits for amounts greater than $5,000 be sent to Kalco via wire transfer. The balance, including any freight charges, is due before shipment. No credit card payments will be accepted for the deposit.
5. Lead time clock starts upon receipt of deposit AND approved/signed drawings.
6. All sales are final and subject to credit approval by Kalco Lighting Limited.
7. Custom manufactured items may not be returned for any reason.
8. Prices and lead times are valid for 90 days from quote date.
9. Fixtures are quoted without lamps and assembled as fully as possible to allow reasonable transportation and storage, and may require final assembly at the job site by a professional. 10. All custom designs are property of Kalco Lighting Limited and may not be reproduced.
